HomeMy WebLinkAboutResolution 00-050 2000-08-22RESOLUTION NO: 00-050 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF EL PASO DE ROBLES TO APPROVE CONDITIONAL USE PERMIT 00-004 (RILEY/AMVETS) APN: 009-814-006 WHEREAS, the applicant, AMVETS, has filed a conditional use permit application to locate a donation trailer at the Wal-Mart parking lot, located at 180 Niblick Road, and WHEREAS, the City Council, on February 15, 2000, adopted Ordinance No. 789 N.S., which amended section 21.16.200.F.14.b of the Municipal Code of the City of El Paso de Robles to require approval of a Conditional Use Permit for Secondhand Merchandise Donation Drop-off in the RC zoning district, and WHEREAS, a public hearing was conducted by the Planning Commission on August 22, 2000, to consider the facts as presented in the staff report prepared for this project, and to accept public testimony regarding this conditional use permit request, and WHEREAS, based upon the facts and analysis presented in the staff report, and public testimony received and subject to the conditions of approval listed below, the Planning Commission finds that the establishment, maintenance or operation for the requested use or building applied for, will not, under the circumstances of the particular case, be detrimental to the health, safety, morals, comfort, convenience and general welfare of the persons residing or working in the neighborhood of such proposed use, or be injurious or detrimental to property and improvements in the neighborhood or to the general welfare of the City. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of El Paso de Robles does hereby approve Conditional Use Permit 00-004 subject to the following conditions: STANDARD CONDITIONS 1. Any site specific condition imposed by the Planning Commission in approving this project may be modified or eliminated, or new conditions may be added, provided that the Planning Commission shall first.conduct a public hearing in the same manner as required for the approval of this project. No such modification shall be made unless the Commission finds that such modification is necessary to protect the public interest and/or neighboring properties, or, in the case of deletion of an existing condition, that such action is necessary to permit reasonable operation and use for this approval. 2. The site shall be kept in a neat manner at all times. SITE SPECIFIC CONDITIONS 3. The project shall be constructed so as to substantially conform with the attached Exhibit A and conditions established by this resolution. 4. This Conditional Use Permit (CUP) authorizes a donation trailer to be located in the Wal- Mart parking lot at 180 Niblick Road, in a manner described in the attached exhibit and as by conditions contained within this resolution. 5. Conditional Use Permit 00-004 would allow for one (1) donation trailer at approximately 8 x 20 feet. 6. Donation facilities are limited to one (1) per twenty (20) acre site per Ordinance No. 786 N.S. (ie.: Woodland Plaza II could accommodate a total of two (2) such facilities). 7. Where two facilities are located in the same center, the trailers shall be located no closer than 1,000 feet from each other per Ordinance No. 786 N.S., unless the property owner/ operator specifically approves a closer distance. In this case the property owner/ operator has allowed two donation trailers to be located closer than 1,000 feet. 8. No signage shall be posted outside of the donation trailer area without a City sign permit and permission from the property owner. Signage within the donation area shall be limited to signs on the tenant space. 9. No outdoor storage is allowed around the donation trailer.
