HomeMy WebLinkAboutResolution 00-018 2000-03-14RESOLUTION NO: 00-018 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF EL PASO DE ROBLES TO GRANT A ONE YEAR TIME EXTENSION FOR TENTATIVE TRACT 1771, PHASES 2-5 (ELLSWORTH/BURKE) APNS: 009-761-047 AND 009-761-048 WHEREAS, on June 19, 1990, the City Council adopted Resolution 90-104 granting tentative tract map approval to Tract 1771, a 195 lot residential subdivision generally located on the north side of Charolais Road between South River Road and Rambouillet Road, and WHEREAS, a resolution was adopted by the City Council granting a Negative Declaration status for this project, and a Negative Declaration was prepared for the proposed subdivision application in accordance with the California Environmental Quality Act, and WHEREAS, under the provisions of the State's Subdivision Map Act the map approval was granted for a two (2) year period of time from the date of City Council action, and WHEREAS, on August 4, 1992, the City Council adopted Resolution 92-128 agreeing to a modification of conditions of approval for Tract 1771 and acknowledging a de facto time extension for Tentative Tract 1771 which established a revised expiration date of February 16, 1993, and WHEREAS, State legislation in 1993 automatically extended the life of the map an additional two (2) years, thereby establishing an expiration date for this map of February 16, 1995, and WHEREAS, on March 16, 1993, the City Council adopted Resolution 93-61 approving the final map for Tract 1771, Phase 1, and WHEREAS, the State mandated an automatic one year time extension accorded to all maps not expired on May 14, 1996, thereby establishing an expiration date for this map of February 16, 1996, and WHEREAS, on June 10, 1997, the Planning Commission adopted Resolution 97-027 amending Tentative Tract 1771, and WHEREAS, in accordance with Section 66452.6 of the State's Subdivision Map Act, if a project is required to expend one hundred twenty-five thousand dollars ($125,000) or more to construct, improve, or fiiance the construction or improvement of public improvements outside the property boundaries of the tentative map, each filing of a final map shall extend the expiration of the approved tentative map by 36 months, and WHEREAS, Tentative Tract 1771, phase 1, conditions of approval required the expenditure of one hundred twenty-five thousand dollars ($125,000) or more to construct, improve, or finance the construction or improvement of public improvements outside the property boundaries of the tentative map thereby establishing an expiration .date of February 16, 1999, and WHEREAS, on February 11, 1999, the applicant filed a request for a one year time extension of the subject tentative tract map, and WHEREAS, on April 13, 1999, the Planning Commission granted a one year time extension (as measured from the most current expiration date of February 16, 1999) to Tentative Tract Map 1771, Phases 2-5, and WHEREAS, on January 26, 2000, the applicant filed a request for a one year time extension of the subject tentative tract map, and WHEREAS, the Planning Commission is empowered through the Zoning Code to approve Tentative Tract maps and their related Time Extension requests, and WHEREAS, under the State's Subdivision Map Act, this is the last time extension that this map will qualify for before reaching the 10 year cumulative maximum for map extensions, and NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of El Paso de Robles does hereby grant a one year time extension (as measured from the most current expiration date of February 16, 2000) to Tentative Tract Map 1771, Phases 2-5, subject to the following conditions: 1. All conditions adopted within Planning Commission Resolution 97-027 (amending Tract 1771) shall remain in full force and effect (on file in the Community Development Department). 2. All conditions adopted within City Council Resolutions 90-104 and 92-128 (de facto time extension and conditions modification) shall remain in full force and effect (on file in the Community Development Department).
